Before you book a trip with Intrepid Travel, please take the time to read and understand the Booking Conditions and additional Special Conditions below which apply to certain trips and themes.  

These conditions apply to bookings made from 9 June 2020 onwards, including new bookings made with credit vouchers issued following trip cancellations. These are designed to provide you with maximum flexibility.

If you booked your trip prior to 9 June 2020, your original Booking Conditions still apply and can be found on our archived Booking Conditions page.

Standard Booking Conditions

The Standard Booking Conditions apply to the country or region you are making the booking from not the destination you are travelling to.

Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us. We strongly recommend that you also read the Essential Trip Information and Important Notes relating to your trip prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.

 1. Our contract 

All bookings are made with Intrepid Travel Australia Pty Ltd (ABN 34 126 440 033) acting as agent for Intrepid Travel Pty Ltd (ABN 35 007 172 456) (us/we). By booking a trip with us you have agreed to be bound by the terms and conditions set out in:

  (a) these Booking Conditions; 
  (b) Essential Trip Information that applies to your trip; and
  (c) any Special Conditions that may apply,
  (which constitutes the entire agreement between you and us). 

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. 

 2. Validity

Dates and itineraries are valid until 31 December 2021. Beyond 31 December 2021 dates and itineraries are indicative only.

3. Deposit requirement

Except as set out in the Special Conditions, you are required to pay a non-refundable deposit of AUD$400 per person per trip for your booking to be confirmed. If your booking is made within 21 days of the departure date then the full amount is payable at the time of booking. Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the Special Conditions

4. Acceptance of booking and final payments   

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 21 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 21 days before the departure date, except as otherwise set out in the Special Conditions. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 7 (Cancellation by You) will apply.

5. Prices and surcharges 

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 21 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Please note that a surcharge may be applied to a purchase made by credit card.

6. Your details  

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. 7. Cancellation by you  

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

 (a) 21 days or more prior to departure, we will hold the deposit amount as a credit;

or

 (b) 20 days or fewer prior to departure:

  • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or
  • if the cancellation is due to you having COVID-19/ “flu-like symptoms”,  supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.

Any credit resulting from a cancellation under this clause 7 (Cancellation by you) does not have an expiry date and may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

Note that different cancellation conditions apply to some styles of trips and additional services as set out in the Special Conditions and the Essential Trip Information relating to your trip. Your booking consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents or third-party tour and transport operator fees. Please refer to clause 19 (Liability), which provides more information about your rights under Australian Consumer Law which may apply to your cancellation.

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions) or when a Force Majeure Event results in the cancellation of a trip. Except when your trip is cancelled due to a Force Majeure Event (as defined below in this clause 8), if we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a refund.  

Cancellation due to Force Majeure

If a trip is cancelled due to a Force Majeure Event, we can offer you a choice of: 

 (a) a 110% credit of monies paid for your trip; or
 (b) a refund minus unrecoverable costs. 

If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:

 (a) 110% credit for the days that remain on your trip; or
 (b) refund minus unrecoverable costs of the days that remain on your trip. 

Any credit resulting from a cancellation under this clause 8 (Cancellation by us): 

  • does not have an expiry date and may be applied towards any other available trip offered by us;
  • is not redeemable for cash;
  • excludes flights or insurance as they will have their own booking conditions.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. 

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

9. Booking amendments 

Transfers to a third party or an alternative trip are only permitted when operationally possible and, in the case of transferring to a third party, where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Prices are set yearly as defined in clause 5 above.

No amendments are permitted to your booking within 21 days of departure.

10.  Inclusions  

The land price of your trip includes:

  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

11. Exclusions  

The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance
  • optional activities and all personal expenses.

12. Age & Health requirements

Minimum Age:

For the majority of our trips, the minimum age is 15 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age:

For the majority of our trips, we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas 

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered.

After departure: We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines. 

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability and service guarantee

Our services which include our trips (“Services”) may come with guarantees that cannot be excluded under Australian Consumer Law. 

“Australian Consumer Law” means the uniform consumer protection law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the CCA).

19.1 To the maximum extent permitted by law (including the CCA) we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the Services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct. This clause does not limit or exclude your rights under the CCA. 

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded (in particular warranties under the CCA) our liability for breach of such a warranty will be limited to either supplying the Services again or payment of the cost of having the services supplied again.

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with:

 (a) your access or use of the Services, this includes your delegate’s access or use of the Services; and

 (b) any breach by you (or your delegate) of:

      (i) these Booking Conditions; or
      (ii) any additional terms applicable to providing the Services,

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia. 

25. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

11. Exclusions  

The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance
  • optional activities and all personal expenses.

12. Age & Health requirements

Minimum Age:

For the majority of our trips, the minimum age is 15 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age:

For the majority of our trips, we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas 

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability 

19.1 To the maximum extent permitted by law we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct. 

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded our liability for breach of such a warranty will be limited to either supplying the services again or payment of the cost of having the services supplied again.

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with:

(a) your access or use of the Services, this includes your delegate’s access or use of the Services; and
(b) any breach by you (or your delegate) of:
      (i) these Booking Conditions; or
      (ii) any additional terms applicable to providing the Services,

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been  resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 
You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia. 

25. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

1. Our contract 

All bookings are made with Intrepid US, Inc acting as agent for Intrepid Travel Pty Ltd (ABN 35 007 172 456) (us/we). By booking a trip with us you have agreed to be bound by the terms and conditions set out in:

 (a) these Booking Conditions; 
 (b) Essential Trip Information that applies to your trip; and
 (c) any Special Conditions that may apply,
 (which constitutes the entire agreement between you and us). 

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. 

2. Validity

Dates and itineraries are valid until 31 December 2021. Beyond 31 December 2021 dates and itineraries are indicative only.

3. Deposit requirement

Except as set out in the Special Conditions, you are required to pay a non-refundable deposit of US$400 per person per trip for your booking to be confirmed. If your booking is made within 21 days of the departure date then the full amount is payable at the time of booking. Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the Special Conditions

4. Acceptance of booking and final payments   

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 21 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 21 days before the departure date, except as otherwise set out in the Special Conditions. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 7 (Cancellation by You) will apply.

5. Prices and surcharges 

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 21 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Please note that a surcharge may be applied to a purchase made by credit card.

6. Your details  

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. For more information about how we treat your personal information please refer to our Privacy Policy.

7. Cancellation by you  

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

(a) 21 days or more prior to departure, we will hold the deposit amount as a credit;

or

(b) 20 days or fewer prior to departure:

  • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or
  • if the cancellation is due to you having COVID-19/ “flu-like symptoms”, supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.

Any credit resulting from a cancellation under this clause 7 (Cancellation by you) does not have an expiry date and may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

Note that different cancellation conditions apply to some styles of trips and additional services as set out in the Special Conditions and the Essential Trip Information relating to your trip. Your booking consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents or third-party tour and transport operator fees. 

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions) or when a Force Majeure Event results in the cancellation of a trip. Except when your trip is cancelled due to a Force Majeure Event (as defined below in this clause 8), if we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a refund.  

Cancellation due to Force Majeure

If a trip is cancelled due to a Force Majeure Event, we can offer you a choice of: 

 (a) a 110% credit of monies paid for your trip; or
 (b) a refund minus unrecoverable costs. 

If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:

 (a) 110% credit for the days that remain on your trip; or
 (b) refund minus unrecoverable costs of the days that remain on your trip. 

Any credit resulting from a cancellation under this clause 8 (Cancellation by us): 

  • does not have an expiry date and may be applied towards any other available trip offered by us;
  • are not redeemable for cash;
  • exclude flights or insurance as they will have their own booking conditions.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. 

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

9. Booking amendments 

Transfers to a third party or an alternative trip are only permitted when operationally possible and, in the case of transferring to a third party, where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Prices are set yearly as defined in clause 5 above.

No amendments are permitted to your booking within 21 days of departure.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been  resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia. 

25. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

1. Our contract 

All bookings are made with Intrepid Travel Incorporated (BN 811474477) acting as agent for Intrepid Travel Pty Ltd (ABN 35 007 172 456) (us/we). By booking a trip with us you have agreed to be bound by the terms and conditions set out in:

 (a) these Booking Conditions; 
 (b) Essential Trip Information that applies to your trip; and
 (c) any Special Conditions that may apply,
 (which constitutes the entire agreement between you and us). 

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. 

2. Validity

Dates and itineraries are valid until 31 December 2021. Beyond 31 December 2021 dates and itineraries are indicative only.

3. Deposit requirement

Except as set out in the Special Conditions, you are required to pay a non-refundable deposit of CAD400 per person per trip for your booking to be confirmed. If your booking is made within 21 days of the departure date then the full amount is payable at the time of booking. Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the Special Conditions

4. Acceptance of booking and final payments   

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 21 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 21 days before the departure date, except as otherwise set out in the Special Conditions. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 7 (Cancellation by You) will apply.

5. Prices and surcharges 

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 21 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Please note that a surcharge may be applied to a purchase made by credit card.

6. Your details  

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. 7. Cancellation by you  

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

 (a) 21 days or more prior to departure, we will hold the deposit amount as a credit;

or

 (b) 20 days or fewer prior to departure:

  • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or
  • if the cancellation is due to you having COVID-19/ “flu-like symptoms”,  supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.

Any credit resulting from a cancellation under this clause 7 (Cancellation by you) does not have an expiry date and may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

Note that different cancellation conditions apply to some styles of trips and additional services as set out in the Special Conditions and the Essential Trip Information relating to your trip. Your booking consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents or third-party tour and transport operator fees. 

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions) or when a Force Majeure Event results in the cancellation of a trip. Except when your trip is cancelled due to a Force Majeure Event (as defined below in this clause 8), if we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a refund.  

Cancellation due to Force Majeure

If a trip is cancelled due to a Force Majeure Event, we can offer you a choice of: 

 (a) a 110% credit of monies paid for your trip; or
 (b) a refund minus unrecoverable costs. 

If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:

 (a) 110% credit for the days that remain on your trip; or
 (b) refund minus unrecoverable costs of the days that remain on your trip. 

Any credit resulting from a cancellation under this clause 8 (Cancellation by us): 

  • does not have an expiry date and may be applied towards any other available trip offered by us;
  • are not redeemable for cash;
  • exclude flights or insurance as they will have their own booking conditions.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. 

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

9. Booking amendments 

Transfers to a third party or to an alternative trip, are only permitted when operationally possible and, in the case of transferring to a third party, where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Prices are set yearly as defined in clause 5 above.

No amendments are permitted to your booking within 21 days of departure.

10.  Inclusions  

The land price of your trip includes:

  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

11. Exclusions  

The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance
  • optional activities and all personal expenses.

12. Age & Health requirements

Minimum Age:

For the majority of our trips, the minimum age is 15 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age:

For the majority of our trips, we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas 

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability 

19.1 To the maximum extent permitted by law we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct. 

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded our liability for breach of such a warranty will be limited to either supplying the services again or payment of the cost of having the services supplied again.

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with:

 (a) your access or use of the Services, this includes your delegate’s access or use of the Services; and
 (b) any breach by you (or your delegate) of:
      (i) these Booking Conditions; or
      (ii) any additional terms applicable to providing the Services,

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

In these Booking Conditions references to "you" and "your" include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

5. Prices and surcharges  

Our advertised trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Once you have received a quote the price will be locked in provided you pay the required deposit prior to the quote’s expiry. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to in such instances we will be responsible for and absorb any increase up to 2% of the trip price and you will be responsible for the amount over and above that. If any surcharge results in an increase of more than 8% of the trip price you may cancel the booking within 7 days of notification of the surcharge and obtain a full refund or change to an alternative holiday, if available and offered by us. Should the cost of your trip decrease due to the changes mentioned above then any refund due will be paid to you less an administration fee of £10. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the cost of your travel due to contractual and other protection in place. There will be no change made to the price of your confirmed holiday within 20 days of your departure nor will refunds be paid during this period. Air Passenger Duty is included in the price of your air inclusive trip. Please note that a surcharge may be applied to a purchase made by credit card.

Should one or more member of a party cancel, it may increase the per person holiday price of those still travelling and you will be liable to pay this increase.

Cancellation by You due to Unavoidable and Extraordinary Circumstances: You have the right to cancel your confirmed holiday before departure without paying a cancellation charge in the event of “unavoidable and extraordinary circumstances” occurring at your holiday destination or its immediate vicinity and significantly affecting the performance of the holiday or significantly affecting the transport arrangements to the destination. In these circumstances, we shall provide you with a full refund of the monies you have paid but we will not be liable to pay you any additional compensation.  Please note that your right to cancel in these circumstances will only apply where the Foreign and Commonwealth Office advises against travel to your destination or its immediate vicinity. For the purposes of this clause 7, “unavoidable and extraordinary circumstances” means warfare, acts of terrorism, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination.

This clause 7 outlines the rights you have if you wish to cancel your booking. Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU).

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions); or when Force Majeure (as defined in clause 27 Force Majeure) results in the cancellation of a trip. 

If we have to cancel your trip, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of: 

 (a) a 110% credit of monies paid for your trip; or
 (b) having a refund of monies paid. 

We will tell you the procedure for making your choice. Please read any notification carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled. 

If you choose to accept a credit resulting from a cancellation under this clause 8 (Cancellation by us): 

  • it does not have an expiry date and may be applied towards any other available trip offered by us; 
  • is not redeemable for cash; 
  • excludes flights or insurance as they will have their own booking conditions. 

If you choose to accept a refund:

 (a) we will provide a full refund of your travel insurance premiums if you paid them to us and can show that you are unable to transfer or reuse your policy;

 (b) we will pay reasonable compensation except where the cancellation is due to unavoidable and extraordinary circumstances, which means a situation beyond our control, the consequences of which could not have   been avoided even if all reasonable measures had been taken.

We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.  

9. Booking amendments and transfers of bookings

Transfers to a third party are only permitted when operationally possible and where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Please note that there may be addition to any charges levied by hotels, ground operators or airlines. Prices are set annually as defined in clause 5 above. No amendments are permitted to your booking within 21 days of departure.

If you or any member of your party is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions: 

 (a) that person is introduced by you and satisfies all the conditions applicable to the holiday;
 (b) we are notified not less than 7 days before departure;
 (c) you pay any outstanding balance payment, as well as any additional fees, charges or other costs arising from the transfer; and 
 (d) the transferee agrees to these booking conditions and all other terms of the contract between us.

You and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, any cancellation charges as set out in clause 7 (Cancellation by you) will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not travelling or for unused services.

Amendments to any other arrangements made in conjunction with your trip may incur additional charges levied by hotels, ground operators or airlines. 

Important Note: Certain arrangements may not be amended or transferred after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements. 

10. Inclusions   

The land price of your trip includes:

  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

11. Exclusions   

The land price of your trip includes: The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance 
  • optional activities and all personal expenses

12. Age & Health requirements 

Minimum Age: For the majority of our trips the minimum age is 15 at the time of travel.  All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian.  The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age: For the majority of our trips we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation.  We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions.  

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas  

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance 

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking.  Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details.  If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.

Before departure:  If we make a significant change, we will inform you as soon as reasonably possible if there is time before departure. The definition of a significant change is deemed to be a change affecting at least one day in five of the itinerary. When a significant change is made you may choose between accepting the changed trip; accepting an alternative trip if available and if offered by us (we will refund any price difference if the alternative tour is of a lower value), or having a refund of monies paid.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.   Where this occurs we will, if possible, make alternative arrangements for you at no extra charge. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines. . 

18. Acceptance of risk 

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks, and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Limitation of liability 

(a). We will accept responsibility for the arrangements we agree to provide or arrange for you as an “organiser” under the Package Travel and Linked Travel Arrangements Regulations 2018, as set out below and as such, we are responsible for the proper provision of all travel services included in your package, as set out in your confirmation invoice. Subject to these Booking Conditions, if we or our suppliers negligently perform or arrange those services and we don’t remedy or resolve your complaint within a reasonable period of time, and this has affected the enjoyment of your package holiday you may be entitled to an appropriate price reduction or compensation or both. You must inform us without undue delay of any failure to perform or improper performance of the travel services included in this package. The level of any such price reduction or compensation will be calculated taking into consideration all relevant factors such as but not limited to: following the complaints procedure as described in these Booking Conditions and the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your holiday.  Please note that it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.

(b). we shall not be liable for any damage or loss if the failure to carry out the contract is:

 i.    attributable to you.
 ii.   attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
 iii.   due to unavoidable and extraordinary circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
 iv.   Force Majeure (see clause 27).

(c). We limit the amount of compensation we may have to pay you if we are found liable under this clause 19 as follows:

 i.    loss of and/or damage to any luggage or personal possessions and money: the maximum amount we will have to pay you in respect of these claims is an amount equivalent to the excess on your insurance policy which applies to this type of loss per person in total because you are required to have adequate insurance in place to cover any losses of this kind.

 ii.    Claims not falling under (a) above and which don’t involve injury, illness or death: the maximum amount we will have to pay you in respect of these claims is up to three times the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.

 iii.    Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation: the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955 and Montreal Convention 1999 (travel by air), Berne Convention 1961 and COTIF 1999 (travel by rail) Athens Convention 1974 (travel by sea) and Paris Convention 1962 (provision of accommodation). We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions. You can ask for copies of these conventions from our offices. Please contact us. In addition, you agree that the operating carrier or transport company's own 'Conditions of Carriage' will apply to you on that journey. When arranging transportation for you, we rely on the terms and conditions contained within these international conventions and those 'Conditions of Carriage'. You acknowledge that all of the terms and conditions contained in those 'Conditions of Carriage' form part of your contract with us, as well as with the transport company and that those 'Conditions of Carriage' shall be deemed to be included by reference into this contract. In any circumstances in which a carrier is liable to you by virtue of EC 261/2004 (denied boarding and flight disruption), any liability we may have to you under our contract with you, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) we were a carrier. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the transport provider or hotelier for the complaint or claim in question.

(d). Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to three (3) times the price paid.  In the case of damaged property, the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.

(e). Our acceptance of liability in this clause is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury and you must provide us and our insurers with all assistance we may reasonably require.

(f). It is a condition of our acceptance of liability under this clause that you notify any claim to us and our supplier(s) strictly in accordance with the complaints procedure set out in these Booking Conditions.

(g). Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description: (i) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you; (ii) relate to any business, (iii) indirect or consequential loss of any kind.

(h). Where it is impossible for you to return to your departure point as per the agreed return date of your package, due to “unavoidable and extraordinary circumstances”, we shall provide you with any necessary accommodation (where possible, of a comparable standard) for a period not exceeding three nights per person. Please note that the 3-night cap does not apply to persons with reduced mobility, pregnant women or unaccompanied minors, nor to persons needing specific medical assistance, provided we have been notified of these particular needs at least 48 hours before the start of your holiday. For the purposes of this clause, “unavoidable and extraordinary circumstances” mean warfare, acts of terrorism, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely back to your departure point.

(i).Flight Notice, Flight Information and EU Blacklist.

This is a notice required by European Community Regulation (EC) No.889/2002.This notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of the Regulation or the Montréal Convention, and it does not form part of the contract between the carrier(s), us and you, nor part of a claim. No representation is made by the carrier(s) or us as to the accuracy of the contents of this notice.

Air carrier liability for passengers and their baggage:

This information notice summarises the liability rules applied by Community air carriers as required by Community legislation and the Montréal Convention. 

Compensation in the case of death or injury: There are no financial limits to the liability for passenger injury or death. For damages, up to 100,000 SDRs (approximately £80,000 / €120,000), the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault. 

Advance payments: If a passenger is killed or injured, the air carrier must make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16000 SDRs (approximately £13,000 /€19,300).

Passenger delays: In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to 4150 SDRs (approximately £3,300 / €5,000).

Baggage delays: In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1000 SDRs (approximately £800/€1,200). 

Destruction, loss or damage to baggage: The air carrier is liable for destruction, loss or damage to baggage up to 1000 SDRs (approximately £800) In the case of checked baggage, it is liable even if not at fault unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.

Higher limits for baggage: A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee. 

Complaints on baggage: If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked baggage, the passenger must write and complain within seven days, and in the case of delay within 21 days, in both cases from the date on which the baggage was placed at the passenger’s disposal.

Liability of contracting and actual carriers: If the air carrier actually performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier.

The time limit for action: Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived. 

The basis for the information. The basis for the rules described above is the Montreal Convention of 28 May 1999, which is implemented in the Community by Regulation (EC) No. 2027/97 (as amended by Regulation (EC) No. 889/2002) and national legislation of the Member States.

In accordance with EU directive (EC) no. 2111/2005, Article 9, we are required to bring to your attention the existence of a ‘Community list’ which contains details of air carriers that are subject to an operating ban within the EU Community. The Community list is available for inspection at www.air-ban.europa.eu.   In accordance with EU Regulation 2111/2005 we are required to advise you of the actual carrier operating your flight/connecting flight/transfer. We do this by listing carriers to be used or likely to be used on our confirming documents. The airline may use wide and narrow-body jets. Any changes to the actual airline after you have received your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate.

20. Optional activities 

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice, given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.  

21. Claims & complaints 

If you have a complaint about your trip you must inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been  resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.Failure to follow the procedure set out in this clause 21 may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your rights under these Booking Conditions.  If we can’t resolve your complaint, you can go to www.abta.com to use ABTA’s simple alternative dispute resolution procedure. You can also access the European Commission Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/. This ODR platform is a means of registering your complaint with us; it will not determine how your complaint should be resolved.

22. Severability 

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy 

Any personal information that we collect about you will be handled in accordance with our Privacy Policy to which the provisions of the European Union’s General Data Protection Regulations apply and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the Trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

Advance Passenger Information: A number of Governments are introducing new requirements for air carriers to provide personal information about all travellers on their aircraft to the Authorities before the aircraft leaves the UK. The data will be collected either at the airport when you check in or in some circumstances when, or after you make your booking. Accordingly, you are advised to allow extra time to check in for your flight. Where we collect this data, we will treat it in accordance with our privacy policy. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Financial protection

The Package Travel and Linked Travel Arrangements Regulations 2018 require us to provide security for the monies that you pay for the package holidays booked from us and for your repatriation in the event of our insolvency.

We provide you with financial protection for any flight-inclusive package or flight that you buy from us by way of our Air Travel Organiser’s Licence (ATOL) number 6352 administered by the Civil Aviation Authority Gatwick Airport South, West Sussex, RH6 0YR, UK, telephone 0333 103 6350, email: claims@caa.co.uk (‘CAA’). When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong. For further information, visit the ATOL website at www.atol.org.uk.  The price of our flight inclusive arrangements includes the amount of £2.50 per person as part of the ATOL Protection Contribution (APC) we pay to the CAA. This charge is included in our advertised prices. Not all holiday or travel services offered and sold by us will be protected by the ATOL Scheme. ATOL protection extends primarily to customers who book and pay in the United Kingdom.

We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable). 

If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have to arise out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body if that other body has paid sums you have claimed under the ATOL scheme.

When you buy an ATOL protected flight or flight inclusive holiday, all money accepted from you by a travel agent acting as our agent is held by that agent on behalf of and for the benefit of the Trustees of the Air Travel Trust at all times, but subject to the agent’s obligation to pay it to us for so long as we do not fail. If we do fail, any money held at that time by the agent, or subsequently accepted from you by the agent, is and continues to be held by that agent on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to us.

When you buy arrangements other than an ATOL protected flight or flight inclusive holiday, all money accepted from you by a travel agent acting as our agent is held by that agent on our behalf at all times.

We will provide you with financial protection for any package holidays you buy from us that do not include flights by way of a bond held by ABTA Ltd, The Travel Association 30 Park Street London SE1 9EQ. For further information, visit the ABTA website at www.abta.com.

If you book arrangements other than an ATOL protected flight or a package holiday, the financial protection referred to above does not apply. 

25. ABTA

We are a Member of ABTA, membership number Y0766. We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you ABTA’s scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. If we can’t resolve your complaint, go to www.abta.com to use ABTA’s simple procedure. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com.

26. Delays and missed transport arrangements

If you or any member of your party miss your flight or another transport arrangement, it is cancelled or you are subject to a delay of over 3 hours for any reason, you must contact us and the airline or other transport supplier concerned immediately.

Under EU Law, you have rights in some circumstances to refunds and/or compensation from the airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be publicised at EU airports and will also be available from airlines. If the airline does not comply with these rules you should complain to the Civil Aviation Authority at www.caa.co.uk/passengers. Reimbursement in such cases is the responsibility of the airline and will not automatically entitle you to a refund of your holiday price from us. If for any reason, you do not claim against the airline and make a claim for compensation from us, you must, at the time of payment of any compensation to you, make a complete assignment to us of the rights you have against the airline in relation to the claim that gives rise to that compensation payment. A delay or cancellation to your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight.

We cannot accept liability for any delay which is due to any of the reasons set out in clause 27 (Force Majeure) of these Booking Conditions (which includes the behaviour of any passenger(s) on any flight who, for example, fails to check in or board on time). 

27. Force majeure

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot,  the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, and adverse weather conditions, epidemics and pandemics or other health emergency, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure.

28. Prompt assistance 

If, whilst you are on the tour, you find yourself in difficulty for any reason, we will offer you such prompt assistance as is appropriate in the circumstances. In particular, we will provide you with appropriate information on health services, local authorities and consular assistance, and assistance with distance communications and finding alternative travel arrangements. Where you require the assistance which is not owing to any failure by us, our employees or sub-contractors we will not be liable for the costs of any alternative travel arrangements or other such assistance you require. Any supplier, airline or another transport supplier may, however, pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these Booking Conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances if you fail to obtain our prior authorisation before making your own travel arrangements. Furthermore, we reserve the right to charge you a fee for our assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through your or your party’s negligence.

29. Applicable law 

The laws of the United Kingdom govern these Booking Conditions to the fullest extent allowable.  Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the United Kingdom.

30. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

Standard Information Form on Traveller’s Rights when booking a Package Holiday 

Part 1: General

The combination of travel services offered to you is a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018. Therefore, you will benefit from all EU rights applying to packages. We, Intrepid Travel Group UK Limited, will be fully responsible for the proper performance of the package as a whole. Additionally, as required by law, we have protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that we become insolvent.

Part 2: Key rights under the Package Travel and Linked Travel Arrangements Regulations 2018

  • Travellers will receive all essential information about the package before concluding the package travel contract.
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
  • Travellers are given an emergency number or details of a contact point where they can get in touch with the organiser or travel agent.
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs rise (for instance fuel prices), and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee. 
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction or compensation for damages or both where the travel services are not performed or are improperly performed.
  • The organiser has to provide assistance if the traveller is in difficulty.
  • If the organiser becomes insolvent, payments will be refunded. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured. Intrepid Travel Group UK has insolvency protection for its flight-inclusive package holidays by way of its Air Travel Organiser’s (ATOL) number 6352 administered by the Civil Aviation Authority (CAA), Gatwick Airport South, West Sussex, RH6 0YR, UK, telephone 0333 103 6350, email: claims@caa.co.uk, and for non-flight packages with by way of a bond held by ABTA Ltd, The Travel Association 30 Park Street London SE1 9EQ. Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us. We strongly recommend that you also read the Essential Trip Information and Important Notes relating to your trip prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.

1. Our contract 

All bookings are made with Intrepid Travel Group UK Limited (01826936) acting as agent for Intrepid Travel Pty Ltd (ABN 35 007 172 456) (us/we). By booking a trip with us you have agreed to be bound by the terms and conditions set out in:

 (a) these Booking Conditions; 
 (b) Essential Trip Information that applies to your trip; and
 (c) any Special Conditions that may apply,
 (which constitutes the entire agreement between you and us). 

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. 

2. Validity

Dates and itineraries are valid until 31 December 2021. Beyond 31 December 2021 dates and itineraries are indicative only.

3. Deposit requirement

Except as set out in the Special Conditions, you are required to pay a non-refundable deposit of EUR275 per person per trip for your booking to be confirmed. If your booking is made within 21 days of the departure date then the full amount is payable at the time of booking. Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the Special Conditions

4. Acceptance of booking and final payments   

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 21 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 21 days before the departure date, except as otherwise set out in the Special Conditions. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 7 (Cancellation by you) will apply.

5. Prices and surcharges 

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 21 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Please note that a surcharge may be applied to a purchase made by credit card.

6. Your details  

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. 7. Cancellation by you  

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

21 days or more prior to departure, we will hold the deposit amount as a credit;

or

20 days or fewer prior to departure:

  • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or
  • if the cancellation is due to you having COVID-19/ “flu-like symptoms”,  supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.

Any credit resulting from a cancellation under this clause 7 (Cancellation by you) does not have an expiry date and may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

Note that different cancellation conditions apply to some styles of trips and additional services as set out in the Special Conditions and the Essential Trip Information relating to your trip. Your booking consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents or third-party tour and transport operator fees. 

Cancellation by You due to Unavoidable and Extraordinary Circumstances: You have the right to cancel your confirmed holiday before departure without paying a cancellation charge in the event of “unavoidable and extraordinary circumstances” occurring at your holiday destination or its immediate vicinity and significantly affecting the performance of the holiday or significantly affecting the transport arrangements to the destination. In these circumstances, we shall provide you with a full refund of the monies you have paid but we will not be liable to pay you any additional compensation.  Please note that your right to cancel in these circumstances will only apply where the relevant official government foreign office of your country advises against travel to your destination or its immediate vicinity. For the purposes of this clause 7, “unavoidable and extraordinary circumstances” means warfare, acts of terrorism, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination.

This clause 7 outlines the rights you have if you wish to cancel your booking. Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU).

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions) or when Force Majeure (as defined in clause 25) results in the cancellation of a trip. 

If we have to cancel your trip, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of: 

 (a) a 110% credit of monies paid for your trip;

or
 (b) having a refund of monies paid. 

We will tell you the procedure for making your choice. Please read any notification carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled. 

If you choose to accept a credit resulting from a cancellation under this clause 8:

  • this credit does not have an expiry date and may be applied towards any other available trip offered by us; 
  • is not redeemable for cash; 
  • excludes flights or insurance as they will have their own booking conditions. 

If you choose to accept a refund under this clause 8:  a. we will provide a full refund of your travel insurance premiums if you paid them to us and can show that you are unable to transfer or reuse your policy;  b. we will pay reasonable compensation except where the cancellation is due to unavoidable and extraordinary circumstances, which means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. 

9. Booking amendments 

Transfers to a third party are only permitted when operationally possible and where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Please note that there may be addition to any charges levied by hotels, ground operators or airlines. Prices are set annually as defined in clause 5 above. 

No amendments are permitted to your booking within 21 days of departure.

Amendments to any other arrangements made in conjunction with your trip may incur additional charges levied by hotels, ground operators or airlines. 

10.  Inclusions  

The land price of your trip includes:

  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

11. Exclusions  

The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance
  • optional activities and all personal expenses.

12. Age & Health requirements

Minimum Age:

For the majority of our trips, the minimum age is 15 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age:

For the majority of our trips, we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions.   

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas 

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered. 

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or Force Majeure.   In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability

a. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law.  Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause c. below.

b. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause c. below.

c. we shall not be liable for any damage or loss if the failure to carry out the contract is:

  • attributable to you.
  • attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
  • due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
  • due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
  • due to an event which the Company, even with all due care, could not foresee or forestall.

d. Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to 3 times the price paid.  In the case of damaged property, the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.

e. Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of the right to claim or compensation contained in these or any conventions.

f. our acceptance of liability in clauses a and b above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury.

g. Flight Notice, Flight Information and EU Blacklist.

This is a notice required by European Community Regulation (EC) No.889/2002.This notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of the Regulation or the Montréal Convention, and it does not form part of the contract between the carrier(s), us and you, nor part of a claim. No representation is made by the carrier(s) or us as to the accuracy of the contents of this notice.

Air carrier liability for passengers and their baggage:

This information notice summarises the liability rules applied by Community air carriers as required by Community legislation and the Montréal Convention.

Compensation in the case of death or injury: There are no financial limits to the liability for passenger injury or death. For damages, up to 100,000 SDRs (approximately £80,000 / €120,000), the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.

Advance payments: If a passenger is killed or injured, the air carrier must make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16000 SDRs (approximately £13,000 /€19,300).

Passenger delays: In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to 4150 SDRs (approximately £3,300 / €5,000).

Baggage delays: In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1000 SDRs (approximately £800/€1,200).

Destruction, loss or damage to baggage: The air carrier is liable for destruction, loss or damage to baggage up to 1000 SDRs (approximately £800) In the case of checked baggage, it is liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.

Higher limits for baggage: A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee.

Complaints on baggage: If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked baggage, the passenger must write and complain within seven days, and in the case of delay within 21 days, in both cases from the date on which the baggage was placed at the passenger’s disposal.

Liability of contracting and actual carriers: If the air carrier actually performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier.

Time limit for action: Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.

Basis for the information. The basis for the rules described above is the Montreal Convention of 28 May 1999, which is implemented in the Community by Regulation (EC) No. 2027/97 (as amended by Regulation (EC) No. 889/2002) and national legislation of the Member States.

In accordance with EU directive (EC) no. 2111/2005, Article 9, we are required to bring to your attention the existence of a ‘Community list’ which contains details of air carriers that are subject to an operating ban within the EU Community. The Community list is available for inspection at  www.air-ban.europa.eu.   In accordance with EU Regulation 2111/2005 we are required to advise you of the actual carrier operating your flight/connecting flight/transfer. We do this by listing carriers to be used or likely to be used on our confirming documents. The airline may use wide and narrow-body jets. Any changes to the actual airline after you have received your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate.

19.1 To the maximum extent permitted by law we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct.  

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded, our liability for breach of such a warranty will be limited to either supplying the services again or payment of the cost of having the services supplied again. 

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with: 
 (a) your access or use of the services, this includes your delegate’s access or use of the services; and 
 (b) any breach by you (or your delegate) of: 
      (i) these Booking Conditions; or 
      (ii) any additional terms applicable to providing the services, 

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct. 

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page. Failure to follow the procedure set out in this clause 21 may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your rights under these Booking Conditions.  If we can’t resolve your complaint, you can access the European Commission Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/. This ODR platform is a means of registering your complaint with us; it will not determine how your complaint should be resolved.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

Advance Passenger Information: A number of governments are introducing new requirements for air carriers to provide personal information about all travellers on their aircraft to the Authorities before the aircraft leaves the European Union. The data will be collected either at the airport when you check in or in some circumstances when, or after you make your booking. Accordingly, you are advised to allow extra time to check in for your flight. Where we collect this data, we will treat it in accordance with our Privacy Policy

24. Delays and missed transport arrangements

If you or any member of your party miss your flight or another transport arrangement, it is cancelled or you are subject to a delay of over 3 hours for any reason, you must contact us and the airline or other transport supplier concerned immediately.

Under EU Law, you have rights in some circumstances to refunds and/or compensation from the airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be publicised at EU airports and will also be available from airlines. Reimbursement in such cases is the responsibility of the airline and will not automatically entitle you to a refund of your holiday price from us. If for any reason, you do not claim against the airline and make a claim for compensation from us, you must, at the time of payment of any compensation to you, make a complete assignment to us of the rights you have against the airline in relation to the claim that gives rise to that compensation payment. A delay or cancellation to your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight.

We cannot accept liability for any delay which is due to any of the reasons set out in clause 25 (Force Majeure) of these Booking Conditions (which includes the behaviour of any passenger(s) on any flight who, for example, fails to check in or board on time). 

25. Force majeure

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot,  the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, and adverse weather conditions, epidemics and pandemics or other health emergency, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control. Advice from the relevant Foreign Office to avoid or leave a particular country may constitute Force Majeure.

26. Prompt assistance 

If, whilst you are on the tour, you find yourself in difficulty for any reason, we will offer you such prompt assistance as is appropriate in the circumstances. In particular, we will provide you with appropriate information on health services, local authorities and consular assistance, and assistance with distance communications and finding alternative travel arrangements. Where you require the assistance which is not owing to any failure by us, our employees or sub-contractors we will not be liable for the costs of any alternative travel arrangements or other such assistance you require. Any supplier, airline or another transport supplier may, however, pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these Booking Conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances if you fail to obtain our prior authorisation before making your own travel arrangements. Furthermore, we reserve the right to charge you a fee for our assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through your or your party’s negligence.

27. Applicable law

The laws of the United Kingdom govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the United Kingdom. 

28. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

Allgemeine Reisebedingungen (ARB) von Intrepid Travel GmbH

Die nachfolgenden Allgemeinen Reisebedingungen (ARB) werden, soweit wirksam vereinbart, Inhalt des zwischen dem Kunden (=Reisender) und dem Reiseveranstalter Intrepid Travel GmbH als Bevollmächtige (nachfolgend INTREPID genannt) zu Stande kommenden Pauschalreisevertrages. Die ARB ergänzen die gesetzlichen Vorschriften der §§ 651a ff. BGB und der Artikel 250 und 252 des EGBGB und füllen diese aus. Bei Buchung einer Pauschalreise ist Vertragspartner des Reiseveranstalters der Reisende – hierbei ist es unerheblich, ob der Reisende die Pauschalreise selbst in Anspruch nimmt oder er den Vertrag für einen anderen Reiseteilnehmer schließt.

Diese ARB gelten ausdrücklich nicht, wenn der Reisende keine Pauschalreise i.S. der §§ 651a ff. BGB, sondern lediglich einzelne Reiseleistungen (z.B. Nur-Hotel, Mietwagen) von INTREPID bucht. Dies gilt auch dann, sofern dem Reisenden für die einzelne Reiseleistung ein Sicherungsschein zur Absicherung des bezahlten Reisepreises ausgehändigt oder soweit INTREPID ausdrücklich als Reisevermittler einer einzelnen Reiseleistung oder einer verbundenen Reiseleistungen gem. § 651w BGB tätig wird und den Reisenden vor Buchung gesondert und unmissverständlich darauf hinweist.

Diese ARB gelten ferner nicht für Verträge über Reisen, soweit der Reisende ein Unternehmer ist, mit dem INTREPID einen Rahmenvertrag für die Organisation von Geschäftsreisen gem. § 651a Abs. 5 lit. 3 BGB für die unternehmerische Zwecke des Reisenden geschlossen hat.

 

1. Abschluss des Pauschalreisevertrages

1.1 Für alle Buchungswege gilt:

  a) Grundlage dieses Angebots ist die Reiseausschreibung von INTREPID nebst ergänzenden Informationen von INTREPID für die jeweilige Reise („Trip-Notes“), sowie sonstiger Medien von INTREPID, soweit diese dem Reisenden bei Buchung vorliegen.

  b) Der Reisende hat für alle Vertragsverpflichtungen von Mitreisenden, für die er die Buchung vornimmt, wie für seine eigenen einzustehen, soweit er diese Verpflichtung durch ausdrückliche und gesonderte Erklärung übernommen hat.

  c) Weicht die Reisebestätigung inhaltlich von der Reiseanmeldung ab, so gilt diese Reisebestätigung als ein neues Angebot, an das INTREPID für die Dauer von zehn Tagen gebunden ist. Der Vertrag kommt auf der Grundlage dieses neuen Angebotes zustande, sofern INTREPID auf die Änderung hingewiesen hat und diesbezüglich seine vorvertraglichen Informationspflichten erfüllt hat und der Reisende innerhalb der Bindungsfrist INTREPID gegenüber die Annahme ausdrücklich oder schlüssig durch (An-) Zahlung des Reisepreises erklärt.

1.2 Für eine Buchung, die nicht im elektronischen Geschäftsverkehr (z.B. im Internet) gebucht wird, gilt:

  a) Durch die Reiseanmeldung (Buchung) bietet der Reisende INTREPID den Abschluss des Pauschalreisevertrages für die angegebenen Personen verbindlich an. INTREPID empfiehlt die Buchung mit dem dafür vorgesehenen Buchungsformular.

  b) Der Vertrag kommt mit Zugang der Reisebestätigung (Annahmeerklärung) von INTREPID zustande. Bei oder unverzüglich nach Vertragsschluss wird INTREPID dem Reisenden eine Reisebestätigung auf einem dauerhaften Datenträger übermitteln. Sofern der Vertragsschluss bei gleichzeitiger körperlicher Anwesenheit erfolgt, hat der Reisende einen Anspruch auf eine Reisebestätigung in Papierform; gleiches gilt bei einem Vertragsschluss außerhalb von Geschäftsräumen.

1.3. Für eine Buchung, die im elektronischen Geschäftsverkehr (z.B. im Internet) gebucht wird, gilt:

  a) Dem Reisenden wird der Ablauf der Onlinebuchung im entsprechenden Internetauftritt erläutert.

  b) Dem Reisenden steht zur Korrektur seiner Eingaben, zur Löschung oder zum Zurücksetzen des gesamten Onlinebuchungsformulars eine entsprechende Korrekturmöglichkeit zur Verfügung, deren Nutzung erläutert wird.

  c) Die zur Durchführung der Onlinebuchung angebotenen Vertragssprachen sind angegeben. 

  d) Soweit der Vertragstext von INTREPID gespeichert wird, wird der Reisende darüber und über die Möglichkeit zum späteren Abruf des Vertragstextes unterrichtet.

  e) Mit Betätigung des Buttons bzw. der Schaltfläche „KOSTENPFLICHTIG BUCHEN“ bietet der Reisende Reiseveranstalter den Abschluss des Reisevertrages verbindlich an.

  f) Dem Reisenden wird der Eingang seiner Buchung (Reiseanmeldung) unverzüglich auf elektronischem Weg bestätigt (Eingangsbestätigung).

  g) Die Übermittlung der Buchung (Reiseanmeldung) durch Betätigung des Buttons „KOSTENPFLICHTIG BUCHEN" begründet keinen Anspruch des Reisenden auf das Zustandekommen eines Pauschalreisevertrages mit INTREPID entsprechend seiner Buchung (Reiseanmeldung). Der Pauschalreisevertrag kommt erst durch den Zugang der Reisebestätigung von INTREPID beim Reisenden zu Stande, die auf einem dauerhaften Datenträger erfolgt.

  h) Erfolgt die Buchungsbestätigung sofort nach Betätigung des Buttons „KOSTENPFLICHTIG BUCHEN“ durch entsprechende unmittelbare Darstellung der Buchungsbestätigung am Bildschirm, so kommt der Pauschalreisevertrag mit Darstellung dieser Buchungsbestätigung zu Stande, ohne dass es einer Zwischenmitteilung über den Eingang der Buchung gem. lit. 

  f) bedarf. In diesem Fall wird dem Reisenden die Möglichkeit zur Speicherung auf einem dauerhaften Datenträger und zum Ausdruck der Reisebestätigung angeboten. Die Verbindlichkeit des Pauschalreisevertrages ist jedoch nicht davon abhängig, dass der Reisende diese Möglichkeiten zur Speicherung oder zum Ausdruck tatsächlich nutzt.

1.4 INTREPID weist darauf hin, dass Buchungen von Pauschalreisen im Fernabsatz (z.B. telefonisch, per E-Mail) nicht nach den §§ 312 Abs. 7, 312g Abs. 2 Satz 1 Nr. 9 BGB widerrufen werden können. Ein Widerrufsrecht besteht jedoch dann, wenn der Vertrag über die Pauschalreise zwischen INTREPID und dem Reisenden, der Verbraucher ist, außerhalb von Geschäftsräumen geschlossen worden ist, es sei denn, die mündlichen Verhandlungen, auf denen der Vertragsschluss beruht, sind auf vorhergehende Bestellung des Verbrauchers geführt worden.

2. Bezahlung

2.1 Nach Vertragsschluss wird eine Anzahlung in Höhe von 20 % des Reisepreises fällig, sofern der Sicherungsschein gemäß § 651r Abs. 4 Satz 1 BGB, Art. 252 EGBGB an den Reisenden in Textform übermittelt wurde. Bei Pauschalreisen, die auf tagesaktuellen Preisen basieren, mit Frühbucherrabatten versehen sind, als  „Special-Deals“ o.ä. bezeichnet sind oder besonders gekennzeichneten Reisen und die aufgrund restriktiver Einkaufskonditionen durch INTREPID bei seinen Leistungsträgern besondere Zahlungsbedingungen haben, ist INTREPID berechtigt, eine höhere Anzahlung zu verlangen. Hierüber wird der Reisende von INTREPID vor Buchungsabschluss in einer nach Art. 250 § 3 EGBGB und in der Reisebestätigung in einer nach Art. 250 § 3 EGBGB vorgeschriebenen Weise informiert. Gleiches gilt, sofern im jeweiligen Angebot enthaltenen Flüge oder Übernachtungsleistungen seitens der Leistungsträger von INTREPID diesem gegenüber sofort zur Zahlung fällig werden oder ein Flugticket sofort nach bestätigter Buchung ausgestellt werden muss. 

Der Restbetrag ist, sofern die Reise nicht mehr aus den in Ziffer 7.1 genannten Gründen abgesagt werden kann und der Sicherungsschein in Textform übermittelt wurde, 21 Tage (bei polaren Reisen 120 Tage) vor Reiseantritt zur Zahlung fällig. Sofern eine Reise noch aus den in Ziffer 7.1 genannten Gründen abgesagt werden kann, ist der Restbetrag für diese Reise erst zu dem Zeitpunkt fällig, in dem die Reise durch INTREPID nicht mehr abgesagt werden kann.

2.2 Bei kurzfristigen Buchungen, d.h. Buchungen, die so kurzfristig vor Reiseantritt erfolgen, dass der gesamte Reisepreis bereits fällig ist oder INTREPID die Reise nicht mehr wegen Nichterreichung der Teilnehmerzahl absagen kann, ist der gesamte Reisepreis sofort zur Zahlung nach in Textform erfolgter Übermittlung des Sicherungsscheines fällig.

2.3 Prämien für Versicherungen und sonstige Auslagen wie Storno- und Umbuchungsentgelte sind nach Rechnungsstellung vollständig zur Zahlung fällig.

2.4 Sofern der Reisende die Anzahlung oder Restzahlung trotz erhaltenen Sicherungsscheins nicht zum jeweiligen Fälligkeitstag leistet, ist INTREPID berechtigt, nach Mahnung mit Fristsetzung vom Vertrag zurückzutreten und den Reisenden mit den in Ziffer 4.1 ff. geregelten Stornierungskosten zu belasten. Dies gilt nur dann nicht, wenn ein gesetzliches oder vertragliches Zurückbehaltungsrecht des Reisenden besteht oder INTREPID zur ordnungsgemäßen Erbringung der vertraglichen Leistungen nicht bereit und in der Lage ist oder seine gesetzlichen Informationspflichten nicht erfüllt hat.

 

3. Leistungen und Leistungsänderungen

3.1 Die Leistungsverpflichtung von INTREPID ergibt sich ausschließlich aus dem Inhalt der Buchungsbestätigung in Verbindung mit dem für den Zeitpunkt der Reise gültigen Katalog bzw. Prospekt, der Website von INTREPID, einem individuellen Angebot oder einem sonstigen Medium von INTREPID unter Maßgabe sämtlicher darin enthaltener Informationen („Trip-Notes“), Hinweise und Erläuterungen sowie der für die gebuchte Pauschalreise relevanten vorvertraglichen Informationen nach Art. 250 § 3 EGBGB.

3.2 Mitarbeiter von Leistungsträgern (z.B. Fluggesellschaften, Hotels) sowie von Reisemittlern sind von INTREPID nicht bevollmächtigt, Zusicherungen oder Auskünfte zu geben, sowie Vereinbarungen zu treffen, die über die Reiseausschreibung, die Buchungsbestätigung oder der vorvertraglichen Informationen nach Art. 250 § 3 EGBGB von INTREPID hinausgehen, im Widerspruch dazu stehen oder den bestätigten Inhalt des Pauschalreisevertrages abändern.

3.3 Änderungen oder Abweichungen einzelner Reiseleistungen von dem vereinbarten Inhalt des Pauschalreisevertrages, die nach Vertragsschluss notwendig werden und die von INTREPID nicht wider Treu und Glauben herbeigeführt wurden, sind nur gestattet, soweit die Änderungen oder Abweichungen nicht erheblich sind und den Gesamtzuschnitt der gebuchten Pauschalreise nicht beeinträchtigen. Darüber hinaus müssen diese Änderungen vor Reisebeginn erklärt werden. INTREPID hat den Reisenden auf einem dauerhaften Datenträger klar, verständlich und in hervorgehobener Weise über die Änderung zu unterrichten.

3.4 Im Falle einer erheblichen Änderung einer wesentlichen Eigenschaft einer Reiseleistung nach Art. 250 § 3 Nr. 1 EGBGB oder einer Abweichung von einer besonderen Vorgabe des Reisenden, die Inhalt des Pauschalreisevertrages wurde, ist der Reisende berechtigt, innerhalb einer von INTREPID gesetzten angemessenen Frist 

  a)    die mitgeteilte Änderung der Reiseleistung oder Abweichung der besonderen Vorgabe anzunehmen,

  b)    ohne Stornokosten vom Vertrag zurückzutreten, oder

  c)    die Teilnahme an einer von INTREPID gegebenenfalls angebotenen Ersatz-Pauschalreise zu erklären.

Wenn der Reisende gegenüber INTREPID nicht oder nicht innerhalb der gesetzten, angemessenen Frist reagiert, gilt die Änderung bzw. Abweichung als angenommen. Hierüber, sowie über die erhebliche Änderung bzw. Abweichung einer besonderen Vorgabe wird der Reisende von INTREPID unverzüglich nach Kenntnis von dem Änderungsgrund zusammen mit der Mitteilung über dessen Rechte nebst Fristsetzung zur Erklärung auf einem dauerhaften Datenträger klar, verständlich und in hervorgehobener Weise unterrichtet.

3.5 Eventuelle Gewährleistungsansprüche bleiben unberührt, soweit die geänderten Leistungen mit Mängeln behaftet sind. Sofern die durchgeführte Ersatz-Pauschalreise oder geänderte Pauschalreise im Vergleich zur ursprünglich geschuldeten Pauschalreise nicht von mindestens gleichwertiger Beschaffenheit, ist der Reisepreis gemäß § 651m Abs. 1 BGB zu mindern; sofern INTREPID bei gleichwertiger Beschaffenheit geringere Kosten entstehen, ist dem Reisenden der Differenzbetrag gemäß § 651m Abs. 2 BGB zu erstatten.

4. Rücktritt durch den Reisenden vor Reisebeginn, Vertragsübertragung (Ersatzperson)

4.1 Der Reisende kann jederzeit vor Reisebeginn vom Pauschalreisevertrag zurücktreten. Der Rücktritt ist gegenüber INTREPID unter den am Ende der ARB angegebenen Kontaktdaten zu erklären. Falls die Reise über einen Reisemittler gebucht wurde, kann der Rücktritt auch diesem gegenüber erklärt werden. Dem Reisenden wird empfohlen, den Rücktritt auf einem dauerhaften Datenträger zu erklären.

4.2 Tritt der Reisende vor Reisebeginn zurück oder tritt er die Reise nicht an, so verliert INTREPID den Anspruch auf den Reisepreis. Stattdessen kann INTREPID eine angemessene Entschädigung vom Reisenden verlangen. Dies gilt nicht, sofern der Rücktritt von INTREPID zu vertreten ist oder wenn am Bestimmungsort oder in dessen unmittelbarer Nähe unvermeidbare, außergewöhnliche Umstände auftreten, die die Durchführung der Pauschalreise oder die Beförderung von Personen an den Bestimmungsort erheblich beeinträchtigen; Umstände sind unvermeidbar und außergewöhnlich, wenn sie nicht der Kontrolle derjenigen Vertragspartei unterliegen, die sich hierauf beruft, und sich ihre Folgen auch dann nicht hätten vermeiden lassen, wenn alle zumutbaren Vorkehrungen getroffen worden wären. In einem solchen Fall hat der Reisende das Recht, die Reise ohne Stornogebühren zu stornieren und eine vollständige Rückerstattung der gezahlten Aufwendungen zu erhalten. Der Reisende hat keinen zusätzlichen Entschädigungsanspruch gegenüber INTREPID für Nebenkosten, die dem Reisenden aufgrund einer Buchung entstanden sind. Das Rücktrittsrecht unter diesen Umständen kommt nur dann zur Anwendung, wenn das zuständige Auswärtige Amt des Heimatlandes des Reisenden von Reisen in das Reiseland oder in dessen unmittelbare Nähe abrät. Im Sinne dieses Absatzes 4.2 sind "unvermeidbare und außergewöhnliche Umstände" Kriegshandlungen, Terrorakte, erhebliche Risiken für die menschliche Gesundheit wie der Ausbruch einer Epidemie am Reiseziel oder Naturkatastrophen wie Überschwemmungen, Erdbeben oder Wetterbedingungen, die eine sichere Reise zum Reiseziel unmöglich machen.

Gemäß Richtlinie 2011/83/EU (Verbraucherrechte-Richtlinie) gibt es kein automatisches gesetzliches Rücktrittsrecht.

4.3 INTREPID hat diesen ihm zustehenden Entschädigungsanspruch in den nachfolgenden Stornopauschalen festgelegt. Die Berechnung erfolgt unter Berücksichtigung des Zeitpunktes des vom Reisenden erklärten Rücktritts bis zum vertraglich vereinbarten Reisebeginn, der zu erwartenden Ersparnis von Aufwendungen und den zu erwartenden Erwerb durch eine anderweitige Verwendung der Reiseleistungen.

Die Entschädigung wird nach dem Zeitpunkt des Zugangs der Rücktrittserklärung bei INTREPID oder dem Reisemittler wie folgt berechnet:

  a) allgemeine Stornopauschale:

  • bis 21. Tag vor Reiseantritt: Intrepid hält die Anzahlung als Gutschrift für zukünftige Buchungen
  • 20 Tage oder weniger vor Reiseantritt: 
    • Intrepid behält 50% der Aufwendungen ein und hält 50% als Gutschrift für zukünftige Buchungen; oder
    • Storniert der Reisende die Reise aufgrund von COVID-19 / grippeähnlichen Symptomen und kann dies mit einem ärztlichen Attest nachweisen, behält Intrepid 100% der Aufwendungen als Gutschrift für zukünftige Buchungen 

Jegliche Gutschrift, die sich aus einer Stornierung gemäß dieser Klausel 4.3 (Rücktritt durch den Reisenden vor Reisebeginn) ergibt, hat kein Ablaufdatum und kann auf jede andere von uns angebotene, verfügbare Reise angerechnet werden. Diese Gutschrift ist nicht übertragbar und kann nicht gegen Bargeld eingelöst werden. Diese Gutschrift schließt Flüge oder Versicherungen aus.

  b) besondere Stornopauschale:

Sonderangebote / Specials, Reisen in polare Gebiete, Adventure Cruising Reisen sowie individuell ausgearbeitete Individual- und Gruppenreisen unterliegen besonderen Stornierungsbedingungen, auf die in der jeweiligen Leistungsbeschreibung bzw. Reiseausschreibung/Angebot und der Reisebestätigung nach Art. 250 §§ 3, 6 EGBGB ausdrücklich hingewiesen wird.

4.4 Dem Reisenden bleibt es in jedem Fall unbenommen, INTREPID nachzuweisen, dass INTREPID durch den Rücktritt lediglich eine wesentlich niedrigere angemessene Entschädigung verlangen kann.

4.5 INTREPID behält sich vor, anstelle der vorstehenden Stornopauschalen eine höhere, konkret berechnete Entschädigung zu fordern, soweit INTREPID das Entstehen wesentlich höherer Aufwendungen als die jeweils anwendbare Stornopauschale nachweisen kann. In diesem Fall ist INTREPID verpflichtet, die geforderte Entschädigung unter Berücksichtigung der ersparten Aufwendungen und sowie abzüglich dessen, was er durch anderweitige Verwendung der Reiseleistungen erwirbt, konkret zu beziffern und auf Verlangen des Reisenden zu begründen.

4.6 Der Abschluss einer Reiserücktrittskostenversicherung wird von INTREPID ausdrücklich empfohlen.

4.7 Ist INTREPID infolge eines Rücktritts zur Rückerstattung des Reisepreises verpflichtet ist, ist die Erstattung unverzüglich, auf jeden Fall aber innerhalb von 14 Tagen nach dem Rücktritt zu leisten.

4.8 Das gesetzliche Recht des Reisenden, auf einem dauerhaften Datenträger gemäß § 651e BGB eine Vertragsübertragung auf einen anderen Reisenden zu erklären (Stellung eines Ersatzteilnehmers), bleibt durch die vorstehenden Bestimmungen unberührt, sofern diese Mitteilung INTREPID nicht später als sieben Tage vor Reiseantritt zugeht. 

5. Umbuchungen durch den Reisenden vor Reisebeginn 

5.1 Ein rechtlicher Anspruch des Reisenden auf eine Änderung hinsichtlich des Reisetermins, des Reiseziels, des Ortes des Reiseantritts, der Unterkunft oder der Beförderungsart (Umbuchung) besteht nicht. Dies gilt selbstverständlich nicht, sofern eine Umbuchung aufgrund unvollständiger oder fehlerhafter vorvertraglicher Informationen gemäß Art. 250 § 3 EGBGB nötig ist; eine solche Umbuchung wird für den Reisenden kostenfrei durchgeführt.

5.2 Die Übertragung der Leistung an einen Dritten ist nur dann zulässig, wenn dies operativ möglich ist und der Dritte alle Anforderungen in Bezug auf die Reise erfüllt. Mögliche Kosten, die durch eine Umbuchung verursacht werden, zum Beispiel für Flüge, Hotels und anderer Leistungen vor Ort, trägt der Reisende.

5.3 Umbuchungswünsche des Reisenden ab 20 Tage vor Reisebeginn können, sofern ihre Durchführung überhaupt möglich ist, nur nach Rücktritt vom Reisevertrag gemäß Ziff. 4.3 zu den dort geltenden Bedingungen und gleichzeitiger Neuanmeldung durchgeführt werden. Dies gilt nicht bei Umbuchungswünschen, die nur geringfügige Kosten verursachen. 

6. Nicht in Anspruch genommene Leistungen

Nimmt der Reisende einzelne Reiseleistungen, die INTREPID ordnungsgemäß angeboten hat, aus Gründen, die vom Reisenden zu vertreten sind, nicht in Anspruch, hat er keinen Anspruch auf eine anteilige Erstattung des Reisepreises. INTREPID wird sich bei den Leistungsträgern um Erstattung der ersparten Aufwendungen bemühen. Diese Verpflichtung entfällt, wenn es sich um völlig unerhebliche Leistungen handelt oder wenn einer Erstattung gesetzliche oder behördliche Bestimmungen entgegenstehen. INTREPID empfiehlt den Abschluss einer Reise-Abbruch-Versicherung.

7. Rücktritt wegen Nichterreichens der Mindestteilnehmerzahl und Kündigung durch INTREPID 

7.1 INTREPID kann wegen Nichterreichens einer Mindestteilnehmerzahl nur dann vom Pauschalreisevertrag zurücktreten, wenn INTREPID

  a)    in der vorvertraglichen Unterrichtung hinsichtlich der gebuchten Pauschalreise die Mindestteilnehmerzahl beziffert, sowie den Zeitpunkt angibt, bis zu welchem vor dem vertraglich vereinbarten Reisebeginn dem Reisenden spätestens die Erklärung zugegangen sein muss, und

  b)    in der Reisebestätigung die Mindestteilnehmerzahl und die späteste Rücktrittsfrist angibt.

Der Rücktritt ist dem Reisenden gegenüber spätestens an dem Tag, der in der vorvertraglichen Unterrichtung und der Reisebestätigung angegeben ist, zu erklären. Sollte bereits zu einem früheren Zeitpunkt ersichtlich sein, dass die Mindestteilnehmerzahl nicht erreicht werden kann, hat INTREPID unverzüglich von seinem Rücktrittsrecht Gebrauch zu machen.

Wird die Reise aus diesem Grund nicht durchgeführt, hat INTREPID unverzüglich, auf jeden Fall aber innerhalb von 14 Tagen nach erklärtem Rücktritt, durch den Reisenden geleistete Zahlungen zurückzuerstatten.

7.2 INTREPID kann den Pauschalreisevertrag ohne Einhaltung einer Frist kündigen, wenn der Reisende die Durchführung der Reise ungeachtet einer Abmahnung durch INTREPID nachhaltig stört oder sich in einem solchen Maß vertragswidrig verhält, dass die sofortige Aufhebung des Vertrages gerechtfertigt ist; dies gilt nicht, sofern ein vertragswidriges Verhalten aufgrund einer Verletzung von vorvertraglichen Informationspflichten entstanden ist. Kündigt INTREPID, so behält INTREPID den Anspruch auf den Reisepreis, muss sich jedoch den Wert der ersparten Aufwendungen sowie diejenigen Vorteile anrechnen lassen, die INTREPID aus einer anderweitigen Verwendung der nicht in Anspruch genommenen Leistungen erlangt, einschließlich der ihm von seinen  Leistungsträgern gutgebrachten Beträge.

7.3 Die von INTREPID angebotenen Touren erfordern aufgrund der mit ihnen verbundenen Anstrengungen vom Reisenden eine gewisse körperliche Belastbarkeit bzw. Kondition, darüber hinaus aber auch Teamgeist und kameradschaftliches Verhalten, sowie die Bereitschaft zur Mithilfe bei eventuell auftretenden Problemen. Auf die Teilnahmevoraussetzungen wird bei den jeweiligen ausgeschriebenen Pauschalreisen ausdrücklich hingewiesen. Sofern sich während der Reise herausstellt, dass der Reisende die Voraussetzungen trotz deren Kenntnis nicht erfüllt, ist INTREPID gleichfalls berechtigt, den Reisevertrag ohne Einhaltung einer Frist zu kündigen.

8. Rücktritt und Kündigung wegen höherer Gewalt

INTREPID kann den Pauschalreisevertrag aufgrund von höherer Gewalt kündigen. Der Rücktritt ist dem Reisenden unverzüglich mitzuteilen. 

Im Falle einer Kündigung durch INTREPID wegen höherer Gewalt:

  • erhält der Reisende eine Gutschrift von 110% der bereits gezahlten Aufwendungen für zukünftige Buchungen; oder
  • erhält der Reisende eine Rückerstattung der bereits gezahlten Aufwendungen

Akzeptiert der Reisende eine Gutschrift, die sich aus einer Stornierung gemäß Klausel 8 ergibt: 

  a)    ist diese auf eine zukünftige Reise mit einem Abreisedatum innerhalb von 18 Monaten nach dem ursprünglichen Abreisedatum anzuwenden

  b)    ist diese Gutschrift nicht gegen Bargeld einlösbar

  c)    schließt diese Gutschrift Flüge oder Versicherungen aus

Nimmt der Reisende eine Rückerstattung in Anspruch, die sich aus der Stornierung gemäß Klausel 8 ergibt:

  a)    erstattet INTREPID die bereits gezahlten Aufwendungen vollständig zurück

  b)    zahlt INTREPID eine angemessene Entschädigung, in Fall gesetzt die Stornierung ist nicht auf höhere Gewalt zurückzuführen. Als höhere Gewalt werden unvermeidbare und außergewöhnliche Umstände bezeichnet, die bei Vertragsabschluss nicht voraussehbar waren und die sich auch dann nicht hätten vermeiden lassen, wenn alle zumutbaren Vorkehrungen getroffen worden wären.

Unter solchen Umständen besteht kein Schadensersatzanspruch einer der beiden Parteien gegen die andere. Der Reisende hat keinen Entschädigungsanspruch gegenüber INTREPID für Nebenkosten, die dem Reisenden aufgrund einer Buchung entstanden sind, einschließlich, aber nicht beschränkt auf Visa, Impfungen, Reiseversicherungskosten oder nicht erstattungsfähige Flüge.

9. Mitwirkungspflichten des Reisenden

9.1 Reiseunterlagen

Der Reisende hat INTREPID oder seinen Reisemittler, bei dem er die Pauschalreise gebucht hat, zu informieren, wenn er die erforderlichen Reiseunterlagen (z.B. E-Ticket-Belege, Hotelvoucher) nicht innerhalb der von INTREPID mitgeteilten Frist erhält.

9.2 Mängelanzeige

INTREPID ist verpflichtet, dem Reisenden die Pauschalreise frei von Reisemängeln zu erbringen. Sollte dies nicht der Fall sein, ist der Reisende verpflichtet, einen Reisemangel INTREPID gegenüber unverzüglich anzuzeigen. Hierzu hat der Reisende seine Mängelanzeige unverzüglich dem Vertreter von INTREPID vor Ort bekannt zu geben. Ist ein Vertreter von INTREPID vor Ort nicht vorhanden und vertraglich nicht geschuldet, hat der Reisende die aufgetretenen Mängel INTREPID direkt gegenüber bekannt zu geben. Die Kontaktdaten eines vor Ort vorhandenen Vertreters von INTREPID nebst dessen Erreichbarkeit sowie die Kontaktdaten von INTREPID für eine Reisemängelanzeige sind der Reisebestätigung zu entnehmen. Der Reisende hat darüber hinaus die Möglichkeit, seine Mängelanzeige auch dem Reisemittler, bei dem er die Pauschalreise gebucht hat, zu übermitteln. 

Der Vertreter von INTREPID ist beauftragt, für Abhilfe zu sorgen sofern dies möglich ist. Er ist jedoch nicht befugt, Ansprüche anzuerkennen.

Soweit INTREPID infolge einer schuldhaften Unterlassung der Mängelanzeige nicht Abhilfe schaffen konnte, kann der Reisende weder Minderungsansprüche nach § 651m BGB noch Schadensersatzansprüche nach § 651n BGB geltend machen.

9.3 Fristsetzung vor Kündigung

Will ein Reisender den Pauschalreisevertrag wegen eines erheblichen Reisemangels der in § 651i BGB bezeichneten Art nach § 651l BGB kündigen, so hat der Reisende INTREPID zuvor eine angemessene Frist zur Abhilfeleistung zu setzen. Dies gilt nur dann nicht, wenn Abhilfe durch INTREPID verweigert wird oder eine sofortige Abhilfe notwendig ist.

9.4 Gepäckverspätung und -beschädigung:

  a) Der Reisende hat nach luftverkehrsrechtlichen Bestimmungen bei Flugreisen Schäden an seinem Reisegepäck oder einen Gepäckverlust oder Gepäckverspätung unverzüglich vor Ort der zuständigen Fluggesellschaft mittels Schadensanzeige (P.I.R.) anzuzeigen und sich aus Nachweisgründen eine Bestätigung in Textform aushändigen zu lassen. Sowohl Fluggesellschaften als auch INTREPID lehnen in der Regel diesbezügliche Erstattungen aufgrund internationaler Übereinkünfte ab, wenn die Schadenanzeige nicht ausgefüllt wurde. Die Schadenanzeige ist bei einer Gepäckbeschädigung binnen 7 Tagen und bei einer Gepäckverspätung binnen 21 Tagen nach Aushändigung zu erstatten.

  b) Darüber hinaus ist die Beschädigung, der Verlust bzw. die Gepäckverspätung unverzüglich INTREPID gem. den Ausführungen in Ziffer 9.2 bekannt zu geben. Eine Bekanntgabe an INTREPID entbindet den Reisenden nicht von der Pflicht der fristgemäßen Schadenanzeige an die zuständige Fluggesellschaft gemäß lit. a).

10. Beschränkung der Haftung

10.1 Die vertragliche Haftung von INTREPID für Schäden, die nicht aus der Verletzung des Lebens, des Körpers oder der Gesundheit resultieren, ist auf den dreifachen Reisepreis beschränkt, soweit diese nicht schuldhaft herbeigeführt wurden. Gelten für eine Reiseleistung internationale Übereinkünfte oder auf solchen beruhende gesetzliche Vorschriften, nach denen ein Anspruch auf Schadensersatz gegen den Leistungserbringer nur unter bestimmten Voraussetzungen oder Beschränkungen entsteht oder geltend gemacht werden kann oder unter bestimmten Voraussetzungen ausgeschlossen ist, so kann sich auch INTREPID gegenüber dem Reisenden hierauf berufen.

10.2 INTREPID haftet nicht für Leistungsstörungen, Personen- und Sachschäden im Zusammenhang mit Leistungen, die als Fremdleistungen lediglich vermittelt werden, wie z.B. Ausflüge, Sportveranstaltungen, Musicalaufführungen, Ausstellungen, wenn diese Leistungen in der Reiseausschreibung und der Buchungsbestätigung ausdrücklich und unter Angabe der Identität und der Adresse des vermittelten Vertragspartners als Fremdleistungen so eindeutig gekennzeichnet werden, dass diese für den Reisenden erkennbar nicht Bestandteil der Pauschalreise von INTREPID sind. INTREPID haftet jedoch für diese Leistungen, wenn und soweit für einen Schaden des Reisenden die Verletzung von Hinweis-, Aufklärungs- oder Organisationspflichten seitens INTREPID ursächlich waren.

10.3 INTREPID haftet nicht für Leistungen, die durch den Reisenden im Rahmen der Pauschalreise in Anspruch genommen werden und nicht von INTREPID oder deren Vertreter vor Ort, sondern beispielsweise durch das Hotel oder andere Personen oder Firmen in eigener Verantwortung vermittelt oder veranstaltet werden.

11. Geltendmachung von Ansprüchen, Verbraucherstreitbeilegung

11.1 Ansprüche nach den §§ 651i Abs. 3 Nr. 2, 4-7 BGB hat der Reisende gegenüber INTREPID geltend zu machen. Die Geltendmachung kann durch den Reisenden auch über den Reisemittler, bei dem er die Pauschalreise gebucht hat, erfolgen. Es wird empfohlen, die Ansprüche auf einem dauerhaften Datenträger geltend zu machen. 

11.2 Die reisevertraglichen Ansprüche des Reisenden verjähren in zwei Jahren; die Verjährungsfrist beginnt mit dem Tag, an dem die Pauschalreise dem Vertrag nach enden sollte.

11.3 Die Abtretung von Ansprüchen gegen INTREPID an Dritte, die nicht Reiseteilnehmer sind, ist ausgeschlossen.

11.4 INTREPID weist nach § 36 VSBG (Verbraucherstreitbeilegungsgesetz) darauf hin, dass INTREPID nicht an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilnimmt und hierzu auch gesetzlich nicht verpflichtet ist. Sollte sich nach Drucklegung eine gesetzliche Pflicht zur Teilnahme an einem solchen Streitbeilegungsverfahren ergeben oder sollte INTREPID freiwillig daran teilnehmen, wird INTREPID die Reisenden hierüber auf einem dauerhaften Datenträger informieren. Bei Vertragsschluss im elektronischen Rechtsverkehr wird auf die europäische Plattform zur Online-Streitbeilegung gemäß Art. 14 Abs. 1 ODR-VO unter https://ec.europa.eu/consumers/odr/ verwiesen.

12. Pass-, Visa und Gesundheitsvorschriften

12.1 INTREPID unterrichtet die Reisenden über allgemeine Pass- und Visaerfordernisse des Bestimmungslandes einschließlich der ungefähren Fristen für die Erlangung von eventuell notwendigen Visa, sowie gesundheitspolizeiliche Formalitäten vor Vertragsabschluss sowie über deren evtl. Änderungen vor Reiseantritt.

12.2 Der Reisende ist verantwortlich für das Beschaffen und Mitführen der behördlich notwendigen Reisedokumente, eventuell erforderliche Impfungen sowie das Einhalten von Zoll- und Devisenvorschriften. Nachteile, die aus der Nichtbeachtung dieser Vorschriften erwachsen, z.B. die Zahlung von Rücktrittskosten, gehen zu seinen Lasten. Dies gilt nicht, wenn INTREPID nicht, nicht ausreichend oder falsch informiert hat.

12.3 INTREPID haftet nicht für die rechtzeitige Erteilung und den Zugang notwendiger Visa durch die jeweilige diplomatische Vertretung, wenn der Reisende INTREPID mit der Besorgung beauftragt hat, es sei denn, dass INTREPID eigene Pflichten schuldhaft verletzt hat.

13. Informationen zur Identität ausführender Luftfahrtunternehmen 

Die EU-Verordnung zur Unterrichtung von Fluggästen über die Identität des ausführenden Luftfahrtunternehmens verpflichtet INTREPID, den Reisenden über die Identität der ausführenden Fluggesellschaften sämtlicher im Rahmen der gebuchten Reise zu erbringenden Flugbeförderungsleistungen bei der Buchung zu informieren. Steht bei der Buchung die ausführende Fluggesellschaft noch nicht fest, so ist INTREPID verpflichtet, dem Reisenden die Fluggesellschaft bzw. die Fluggesellschaften zu nennen, die wahrscheinlich den Flug bzw. die Flüge durchführen wird bzw. werden. Sobald INTREPID weiß, welche Fluggesellschaft den Flug durchführen wird, muss INTREPID den Reisenden informieren. Wechselt die dem Reisenden als ausführende Fluggesellschaft genannte Fluggesellschaft, muss INTREPID den Reisenden über den Wechsel informieren. INTREPID muss unverzüglich alle angemessenen Schritte einleiten, um sicherzustellen, dass der Reisende so rasch wie möglich über den Wechsel unterrichtet wird.

14. Anwendbares Recht, Gerichtsstand

14.1 Auf das Vertragsverhältnis zwischen dem Reisenden und INTREPID findet deutsches Recht Anwendung.

14.2 Der Reisende kann INTREPID nur an dessen Sitz verklagen. Für Klagen von INTREPID gegen den Reisenden ist der Wohnsitz des Reisenden maßgebend. Für Klagen gegen Reisende, die Kaufleute, juristische Personen des öffentlichen oder privaten Rechts oder Personen sind, wird als Gerichtsstand der Sitz von INTREPID vereinbart, sofern diese ARB aufgrund eines fehlenden Rahmenvertrages zur Abwicklung von Geschäftsreisen für das Unternehmen des Reisenden anwendbar sind. Gleiches gilt für Reisende, die ihren Wohnsitz oder gewöhnlichen Aufenthaltsort in einem Drittland haben oder deren Wohnsitz oder gewöhnlicher Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt ist

14.3 Die vorstehenden Bestimmungen gelten nicht, 

  a) wenn und insoweit sich aus vertraglich nicht abdingbaren Bestimmungen internationaler Abkommen, die auf den Pauschalreisevertrag zwischen dem Reisenden und INTREPID anzuwenden sind, etwas anderes zugunsten des Reisenden ergibt, oder     

  b) wenn und insoweit auf den Pauschalreisevertrag anwendbare, nicht abdingbare Bestimmungen im Mitgliedstaat der EU, dem der Reisende angehört, für den Reisenden günstiger sind, als die vorstehenden Bestimmungen oder die entsprechenden deutschen Vorschriften.

Die im Rahmen der Buchung der Pauschalreise von den Reisenden zur Verfügung gestellten personenbezogenen Daten werden elektronisch verarbeitet und von Intrepid Travel GmbH und deren Leistungsträgern (Beförderungsunternehmen, Hotels, Incoming-Agenturen, Datenbankanbieter Einreise- und gesundheitspolizeilicher Vorschriften) genutzt und im weltweit genutzten Reservierungssystem (GDS) AMADEUS/SABRE verarbeitet und gespeichert, soweit sie zur Vertragsdurchführung erforderlich sind. Aufgrund eines US-Bundesgesetzes zur Terroristenfahndung sind die Fluggesellschaften gezwungen, die Flug- und Reservierungsangaben jedes Passagiers vor der Einreise in die USA der US-Transportsicherheitsbehörde (TSA) mitzuteilen. Ohne diese Datenübermittlung ist eine Einreise in die USA nicht möglich – dies betrifft auch Zwischenlandungen sowie Umsteigeflüge. Auch bei Flügen in andere Staaten, die lediglich den Luftraum der USA tangieren, müssen diese Daten ebenfalls zwingend übermittelt werden.

Die Vorschriften der DSGVO finden Anwendung. Die ausführlichen Datenschutzhinweise einschließlich der Rechte der Reisenden sind auf www.intrepidtravel.com hinterlegt, können unter den Kontaktdaten von Intrepid Travel GmbH angefordert werden bzw. werden zum Zeitpunkt der Erhebung der Daten (Reiseanfrage / Reisebuchung) zur Verfügung gestellt

Fernabsatzverträge:

Intrepid Travel GmbH weist darauf hin, dass Buchungen von Pauschalreisen im Fernabsatz (z.B. telefonisch, per E-Mail) nicht nach den §§ 312 Abs. 7, 312g Abs. 2 Satz 1 Nr. 9 BGB widerrufen werden können. Ein Widerrufsrecht besteht jedoch dann, wenn der Vertrag über die Pauschalreise zwischen Intrepid Travel GmbH und dem Reisenden, der Verbraucher ist, außerhalb von Geschäftsräumen geschlossen worden ist, es sei denn, die mündlichen Verhandlungen, auf denen der Vertragsschluss beruht, sind auf vorhergehende Bestellung des Verbrauchers geführt worden.

Reiseversicherungen:

Intrepid Travel GmbH empfiehlt dringendst den Abschluss einer Reise-Rücktrittskosten-Versicherung und einer Auslands-Reise-Krankenversicherung einschließlich Deckung der Rückführungskosten bei Unfall oder Krankheit.

1. Our contract 

All bookings are made with  Intrepid Travel Pty Ltd (ABN 35 007 172 456) (us/we). By booking a trip with us you have agreed to be bound by the terms and conditions set out in:
 (a) these Booking Conditions; 
 (b) Essential Trip Information that applies to your trip; and
 (c) any Special Conditions that may apply,

 (which constitutes the entire agreement between you and us). 

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. 

2. Validity

3. Deposit requirement

Except as set out in the Special Conditions, you are required to pay a non-refundable deposit of US$400 per person per trip for your booking to be confirmed. If your booking is made within 21 days of the departure date then the full amount is payable at the time of booking. Deposit amounts vary for selected trips and special campaigns that may be run by us from time to time, as set out in and subject to the Special Conditions

4. Acceptance of booking and final payments   

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 21 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 21 days before the departure date, except as otherwise set out in the Special Conditions. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 7 (Cancellation by You) will apply.

5. Prices and surcharges 

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply as set out below in clause 7 (Cancellation by You). The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2020; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 21 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Please note that a surcharge may be applied to a purchase made by credit card.

6. Your details  

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. 7. Cancellation by you  

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

(a) 21 days or more prior to departure, we will hold the deposit amount as a credit;

or
(b) 20 days or fewer prior to departure:

  • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or
  • if the cancellation is due to you having COVID-19/ “flu-like symptoms”,  supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.

Any credit resulting from a cancellation under this clause 7 (Cancellation by you) does not have an expiry date and may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

Note that different cancellation conditions apply to some styles of trips and additional services as set out in the Special Conditions and the Essential Trip Information relating to your trip. Your booking consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers, travel agents or third-party tour and transport operator fees. 

8. Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise (which will be stated in your Essential Trip Information and/ or the Special Conditions) or when a Force Majeure Event results in the cancellation of a trip. Except when your trip is cancelled due to a Force Majeure Event (as defined below in this clause 8), if we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a refund.  

Cancellation due to Force Majeure

If a trip is cancelled due to a Force Majeure Event, we can offer you a choice of: 

 (a) a 110% credit of monies paid for your trip; or
 (b) a refund minus unrecoverable costs. 

If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:

 (a) 110% credit for the days that remain on your trip; or
 (b) refund minus unrecoverable costs of the days that remain on your trip. 

Any credit resulting from a cancellation under this clause 8 (Cancellation by us): 

  • does not have an expiry date and may be applied towards any other available trip offered by us;
  • are not redeemable for cash;
  • exclude flights or insurance as they will have their own booking conditions.

In such circumstances there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. 

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

9. Booking amendments 

Transfers to a third party or an alternative trip are only permitted when operationally possible and, in the case of transferring to a third party, where the transferee meets all the requirements in relation to the trip. Certain fees may apply. Prices are set yearly as defined in clause 5 above.

No amendments are permitted to your booking within 21 days of departure.

10.  Inclusions  

The land price of your trip includes:

  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

11. Exclusions  

The land price of your trip does not include:

  • international or internal flights unless specified
  • airport transfers, taxes and excess baggage charges unless specified
  • meals other than those specified in the Essential Trip Information
  • visa and passport fees
  • travel insurance
  • optional activities and all personal expenses.

12. Age & Health requirements

Minimum Age:

For the majority of our trips, the minimum age is 15 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Maximum Age:

For the majority of our trips, we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional terms

For additional terms that apply to certain trips, please see the Special Conditions

Due to the nature of some of our trips, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your trip. To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver, the terms of these Booking Conditions shall prevail and supersede any supplemental waiver. We reserve the right to deny participation to You if you have not signed a waiver.

14. Passport and visas 

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability 

19.1 To the maximum extent permitted by law we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct. 

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded our liability for breach of such a warranty will be limited to either supplying the services again or payment of the cost of having the services supplied again.

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with:

 (a) your access or use of the Services, this includes your delegate’s access or use of the Services; and
 (b) any breach by you (or your delegate) of:
      (i) these Booking Conditions; or
      (ii) any additional terms applicable to providing the Services,

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been  resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia. 

25. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

Your passport must be valid 6 months after the last date of travel with is as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

15. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. 

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative trip offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visas, vaccinations or non-refundable flights.

17. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our Responsible Travel Guidelines

18. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. 

You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip. 

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

19. Liability 

19.1 To the maximum extent permitted by law we exclude all liability whatsoever to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the services or any other matter or thing relating to these Booking Conditions except to the extent that such loss or damage is incurred as a direct result of our fraud or wilful misconduct. 

19.2 (Limitation of Liability) Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded our liability for breach of such a warranty will be limited to either supplying the services again or payment of the cost of having the services supplied again.

19.3 (Indemnity) You indemnify us (and all of our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of or in connection with:

 (a) your access or use of the Services, this includes your delegate’s access or use of the Services; and
 (b) any breach by you (or your delegate) of:
      (i) these Booking Conditions; or
      (ii) any additional terms applicable to providing the Services,

except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.

19.4 (Third parties) We contract with a network of companies, activity providers, accommodation providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the running of our trips as agent for these third parties (Third Party Supplier). Third Party Suppliers may also engage the services of local operators and sub-contractors. Although we take all reasonable steps to select reputable Third Party Suppliers, we cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers may be subject to the terms and conditions imposed by these Third Party Suppliers and you may be required to sign additional terms as set out in clause 13. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
We are not responsible for the acts and omissions, whether negligent or otherwise, of these Third Parties Suppliers. Any disputes between you and any third party, are to be resolved solely between you and that party.

19.5 (Vicarious liability) We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by us nor for any intentional or negligent acts of our employees committed while off duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

21. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been  resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip through our General Enquiries page.

22. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

23. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers. 

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

24. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia. 

25. Assignment and Registered address

We can assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a related body corporate (as defined in the Corporations Act 2001 (Cth)), at its sole discretion on written notice to You (including notice via the Website).

Special Conditions

The Special Conditions set out below, apply to the trips and themes noted below, and deviate from the standard Booking Conditions. These Special Conditions apply globally. Except as specified the standard Booking Conditions otherwise apply to your trip.

The following conditions apply to trips on the Ocean Endeavor ship to the Antarctic. 

  • Clause 3 (Deposit requirement): 
    • You are required to pay a non-refundable deposit of 20% of the full voyage cost (before any discount) per person per trip for your booking to be confirmed. If your booking is made within 95 days of the departure date, then the full amount is payable at the time of booking.
  • Clause 4 (Acceptance of booking and final payments): 
    • A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 95 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 95 days before the departure date. 
  • Clause 7 (Cancellation by you):
    • If you cancel a trip:
      • 30 days or more before departure we will hold the amount of monies paid on credit for a future booking to be taken before March 2023.  Please note that this change of departure date without fee can be applied only once. 
      • fewer than 30 days before departure the cancellation fee is 100% of monies paid.  
    • Please note that customers booking in the United Kingdom and Europe may have additional rights when cancelling due to “unavoidable and extraordinary circumstances”. Please refer to clause 7 of the Booking Conditions. 

The following conditions apply to trips run by our partner Quark to both Antarctica and the Arctic region.

  • Clause 3 (Deposit requirement): 
    • You are required to pay a non-refundable deposit of 20% of the full voyage cost (before any discount) per person per trip for your booking to be confirmed. If your booking is made within 120 days of the departure date, then the full amount is payable at the time of booking.
  • Clause 4 (Acceptance of booking and final payments): 
    • A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 120 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of the trip price is due 120 days before the departure date. 
  • Clause 7 (Cancellation by you):
    • If a booking is cancelled 120 days or more before departure - the cancellation fee is the full loss of the deposit paid. 
    • If a booking is cancelled fewer than 120 days before departure - the cancellation fee is 100% of the total price of the voyage. 
    • Please note that customers booking in the United Kingdom and Europe may have additional rights when cancelling due to “unavoidable and extraordinary circumstances”. Please refer to clause 7 of the Booking Conditions. 

For all Australian trips, including those operated by our partner Adventure Tours Australia: 

  • Clause 3 (Deposit requirement): 
    • You are required to pay a non-refundable deposit of AUD99, USD99, EUR75.00, NZD99.00, GBP49.00, CAD99.00, CHF75.00, ZAR999.00 per person per trip for your booking to be confirmed. 

For all Australian trips which are operated by our partner Adventure Tours Australia:

  • Clause 3 (Deposit requirement): 
    • If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking. 
  • Clause 4 (Acceptance of booking and final payments): 
    • A contract will exist between you and us from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your payment.  
    • Payment of the balance of the trip price is due 30 days before the departure date.  
  • Clause 7 (Cancellation by you): 

    If you cancel a trip:

    • (a) 30 days or more prior to departure, we will hold the deposit amount as a credit;  or
    • (b) 29 days or fewer prior to departure:  
      • we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking; or  
      • and the cancellation is due to you having COVID-19/ “flu-like symptoms”, supported by a medical certificate, we will hold 100% of monies paid by you in connection with the booking as credit.  
  • Clause 13 (Additional terms): 
    • Pursuant to clause 13 of the Booking Conditions, the ground supplier of our trips in North America requires a waiver to be agreed and signed by you on day 1 of your trip, in order to meet their insurance requirements.  A copy of this waiver can be provided to you prior to departure on request.  To the extent there are any inconsistencies between the terms of these Booking Conditions and the supplemental waiver the terms of these Booking Conditions shall prevail.
  • Clause 3 (Deposit requirement): 
    • All trips requiring a gorilla permit involve a higher non-refundable deposit (AUD 1000, USD 1000, EUR 800, NZD 1250, GBP 650, CAD 1000, ZAR 8000, CHF 900) in order to secure the included gorilla permit. Please note that we need to confirm availability of a gorilla permit if you are booking within 45 days of departure before confirming your booking.
       
  • Clause 3 (Deposit requirement): 
    • You are required to pay a non-refundable deposit of AUD99, USD99, EUR75.00, NZD99.00, GBP49.00, CAD99.00, CHF75.00, ZAR999.00 per person per trip for your booking to be confirmed. 
  • Clause 12 (Age and Health Requirements):
    • You must be older than 18 years and younger than 30 years on day 1 of your trip to travel on our 18 to 29s Adventures. 
       
  • Clause 12 (Age and Health Requirements):
    • All family trips have a minimum age of 5 years old at the time of travel except our “Teenage” trips which require a minimum age of 10 years old.
    • All bookings for our Family trips must include a child under the age of 18.
    • Please note we cannot guarantee triple or adjoining rooms for families; accompanying adults may be required to share with others in the group on a twin share basis.
       

Booking Conditions for our Tailor-Made trips vary depending on the location and type of itinerary being prepared. Our Tailor-Made team will inform you of the applicable conditions for your trip at the time of booking.

Please note that if you have purchased flights in addition to your Intrepid itinerary, for example, flights to and from your trip, different payment terms to those set out in the Standard Booking Conditions may apply. You will be advised of these differences at the time of booking.
